The Tenth Session of the Assembly Presidency of the Association of Municipalities and Cities of the Federation of Bosnia and Herzegovina was held

A panel discussion on the harmonization of local-level legislation with the European Charter of Local Self-Government will be held at the end of April with the participation of representatives of the legislative and executive branches of the Federation of Bosnia and Herzegovina.

The Tenth Session of the Assembly Presidency of the Association of Municipalities and Cities of the Federation of Bosnia and Herzegovina was held on Tuesday, 27 February 2024, in Tešanj, in the hall of the Municipal Council.
The Presidency was informed about the activities of the Association’s working bodies through the work of the committees, as well as about the decision of the Constitutional Court of FBiH regarding the Law on Accounting and Auditing of FBiH, which has a positive outcome for local-self government units, and about the Association’s activities related to the Law on Electricity in FBiH.

The Presidency was acquainted with the Report from the First Extraordinary Session of the Committee on Local Self-Government of the House of Representatives of the Parliament of FBiH related to the Association’s Request for urgent action to ensure respect for the principles of the rule of law and legal certainty, the principles of the European Charter of Local Self-Government, and the Law on Principles of Local Self-Government in the Federation of BiH, as well as the planned Panel Discussion on this topic which the Association, in cooperation with the Council of Europe, will organize at the end of April in Sarajevo. The mentioned panel discussion will highlight the overdue obligation of higher levels of government regarding the harmonization of legislation with the European Charter of Local Self-Government and the Law on Principles of Local Self-Government in FBiH.

“Within the framework of the Panel Discussion, the relationship between the authorities in the Federation of Bosnia and Herzegovina and local self-government units will be discussed. In addition, at the Tenth Session of the Presidency, we touched upon the law on Principles of Local Self-Government in FBiH and its harmonization with other laws, “ said Mladen Mišurić-Ramljak, President of the Assembly Presidency of the Association of the Municipalities and Cities of the FBiH and Mayor of Kiseljak.

President Mišurić-Ramljak noted that representatives of the Association held a meeting with the Minister of Justice of the FBiH, and discussed the conflict between the Law on the Organization of Government Bodies in FBiH and the Law on Principles of Local Self-Government in FBiH regarding the adoption of regulations on the internal structure and systematization of workplaces of government bodies and other services. “The Law on the Organization of Government Bodies in FBiH states that the municipal council adopts this, while the Law on Principles of Local Self-Government in FBiH states that the mayor adopts it. We also discussed the amendments and supplements to the Law on Compensation for Flooded Land in cooperation with the Federal Minister of Spatial Planning, where we reached a compromise solution for the adoption of a new Law concerning local self-government units whose land is flooded, or hydroaccumulation for electricity production,” explained President Mišurić-Ramljak.

The President of the Assembly of the Association of Municipalities and Cities of FBiH and the Mayor of Tešanj, Suad Huskić, stated that the Tenth Session of the Association’s Presidency discussed very important topics for the work of local self-government units, from electricity to water resources and construction land.
“The Association of Municipalities and Cities of FBiH is a serious organization in which local communities participate and it has its own working bodies. Local communities need to insist on a better position with higher levels of government,” emphasized Huskić.

The Presidency of the Association adopted a conclusion to send an initiative to the Government and Parliament of FBiH to adopt a Law on the Protection and Welfare of Animals in FBiH in order to address this issue. The Association of Municipalities and Cities of the Federation of Bosnia and Herzegovina, in accordance with Article 51 of the Law on Principles of Local Self-Government in the FBiH (“Official Gazette of FBiH”, No. 49/06 and 51/09), is the legal representative of local self-government units before the authorities in the Federation of Bosnia and Herzegovina.
